Class Action Investigation – Bonus/Overtime Miscalculation

About the Investigation:
Your employer may be miscalculating your overtime pay if you receive bonuses. Read on to find out how…
What’s wrong with this picture below?
- John Doe works at ABC Store as an hourly employee for $20 an hour.
- When John works overtime, he gets paid time and a half per state law ($30 an hour).
- Every so often throughout the year, John gets a bonus from his employer for sales he has made. This year, John has received $50,000 in bonuses.
- John has never been paid more than time and a half his regular hourly pay for his overtime hours ($30 an hour).
That is a VIOLATION of wage laws! The employer SHOULD have included the $50,000 bonus when calculating John’s base salary for overtime pay. So, John really should have been paid about $39 an hour for OVERTIME.
